Role and Responsibilities of a Governor

  • The Governor has the same power at the state level as a President has at the national level. Every action taken in a state is taken by the executive power (Chief Minister) of that state in the name of the Governor.

  • The Governor has legislative, judicial, executive and financial powers.
  • The Governor has the power to address, summon, differ and dissolve the state assemblies.
  • In case of emergency, the Governor reserves the right to make advances from the State Contingency Fund.
  • The Chief Justice of the State High Court is chosen with the consent of the Governor of the State.
  • In case no political party wins the Lok Sabha elections and is unable to prove majority, the Governor retains the right to elect the Chief Minister of his/her state.
  • If there is a constitutional emergency then President’s rule is imposed in the state by the Governor.
  • With the consent of the Election Commission, he can disqualify any member from election.
  • State MLAs prepare the state budget keeping in mind the opinion of the Governor.

Under Article 157 and Article 158 of the Constitution of India, the eligibility criteria for the post of Governor are as follows:
A Governor must have the following qualifications:

  • Be a citizen of India.
  • Must be at least 35 years of age.
  • Should not be a member of any House of Parliament or a member of the State Legislature.
  • Do not hold any position of profit.

In India, the Governor is appointed by the President. The central government is responsible for the nomination of the government for each state. Unlike the election of the President, there is no indirect or direct election for the appointment of the Governor. The office of the Governor is an independent constitutional office, the Governor does not serve the Central Government.

Chief Minister of India Selection and Powers

According to the Constitution of India, there is no specific procedure for the selection and appointment of the Chief Minister of a state. According to Article 164, the government of a state appoints the Chief Minister. To become the Chief Minister of India, a person requires certain qualifications. The person must be a citizen of India, must have completed 25 years of age, and must be a member of either the Legislative Assembly or the Legislative Council.

A citizen of India who is not a member of the Legislative Assembly or Legislative Council has to get himself elected within 6 months from the date of his appointment, if the person fails in this process, he will not be considered as the Chief Minister.

The powers given to the Chief Minister are that he can allocate and reshuffle the portfolios among the ministers, if the Chief Minister resigns then the entire cabinet has to resign along with him, if there is any difference of opinion then he can control the activities of all the ministers and Directs. , he can ask the minister to resign, he advises the government to appoint any person as minister.
